This 28th day of November, 2018, the Board of County Commissioners met in regular session with the following members present: Roy Klopfenstein, Mark Holtsberry and Cindy Peters, Clerk absent: Tony Zartman

ALLOWANCE OF CLAIMS

Warrants documented as 247089 through 247168 for County Bills were approved and certified to the County Auditor for payment.

IN THE MATTER OF APPROVING ‘THEN AND NOW’ PURCHASE ORDERS AND PAYMENTS

Mr. Mark Holtsberry moved to adopt the following resolution;

WHEREAS, the Paulding County Auditor has certified the following “Then and Now” purchase order number and payment included in the Allowance of Claims on November 26, 2018, Warrants numbered 247051 through 247085 in the amount of $1,982.23; and

WHEREAS, it is certified that both at the time that the contract or order was made (“then”), and at the time that the County Auditor is completing the certification (“now”), that sufficient funds were available or in the process of collection, to the credit of a proper fund, properly appropriated and free from any previous encumbrance; and 

WHEREAS, pursuant to the Ohio Revised Code §5705.41(D)(1), these purchases must be approved by resolution of the Board of County Commissioners; now, therefore

BE IT RESOLVED, that the Paulding County Commissioners approve the Then and Now Purchase Orders as submitted by the Auditor; and

BE IT FURTHER RESOLVED, that it is found and determined that all formal actions of this Board of County Commissioners, County of Paulding, State of Ohio concerning the adoption of this resolution were adopted in an open meeting of this Board of County Commissioners, and that all deliberations of this Board of County Commissioners and of any of its committees that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements including Section §121.22 of the Ohio Revised Code.

BE IT RESOLVED, that the Board of County Commissioners does hereby modify the 2018 Annual Appropriation and hereby directs the Paulding County Auditor to transfer funds in the Engineer Gas Tax Fund (Fund 009), to wit;

IN THE MATTER OF SUPPLEMENTAL APPROPRIATION (FUND 078)

BE IT RESOLVED, that the Board of County Commissioners does hereby direct the County Auditor to make a Supplemental Appropriation in the Infrastructure Projects Fund (Fund 078); to-wit: FROM: Pay-in #119812 TO: 078-001-00001/Infrastructure Projects/Infrastructure Expense AMOUNT: $ 45,051.57

IN THE MATTER OF CREATING AND APPROPRIATING A NEW EXPENSE LINE ITEM FOR FUND 284

BE IT RESOLVED, that the Board of County Commissioners does hereby direct the County Auditor to create a new expense line item to accurately track expenses and appropriate to the following expense line item for  the WPCLF Grant Fund (Fund 284) for the county; to-wit; Expense Line Item  284-001-00002 Admin Cost Appropriation $ 6,526.17

IN THE MATTER OF ENTERING INTO A PARTICIPATION AGREEMENT REGARDING ENERGY PURCHASING PROGRAMS OF THE CCAO SERVICE CORPORATION (CCAOSC) 

WHEREAS, The County Commissioners Association of Ohio (CCAO), through its affiliate CCAOSC, has established a joint purchasing program under the authority of Revised Code Section 9.48 in order to assist eligible Ohio counties or boards, agencies, districts or other instrumentalities which are affiliated with them in securing competitively priced energy supplies through various energy purchasing programs under contractual terms favorable to Participants, and

WHEREAS, Paulding County is an Ohio county which is a member of CCAO and wishes to participate in the Program, and

WHEREAS, CCAOSC wishes to avail itself of the expertise of the Manager in administering the Program.  The Manager is a subsidiary of Palmer Energy Company, Toledo, Ohio, and

WHEREAS, CCAOSC and Paulding County agree that it is necessary and desirable that this Agreement be entered into in order to create and adopt comprehensive guidelines for the funding, management and administration of CCAOSC’s energy purchasing Programs, now, therefore

BE IT RESOLVED, on November 28, 2018, the Paulding County Board of Commissioners entered into a Participation Agreement Regarding Electricity Purchase Program of the CCAO Service Corporation (CCAOSC) with CCAO Service Corporation and CCAOSC Energy Solutions including Exhibit B “Electricity Purchasing Program and Exhibit C “Electric Aggregation Purchasing Program” effective for a period of not more than (5) five years from the commencement date thereof.

IN THE MATTER OF ENTERING INTO AN ENTERPRISE ZONE AGREEMENT WITH INSOURCE TECHNOLOGIES, INC.

WHEREAS, Insource Technologies, Inc. is desirous of maintaining and expanding their operations in Paulding, Ohio, with additions to real property and the addition of employment opportunities in the Enterprise Zone provided the appropriate development incentives are available; and

WHEREAS, Jackson Township Trustees of Paulding County is desirous of providing InSource Technologies, Inc. with tax incentives pursuant to Chapter 5709 of the Ohio Revised Code; and

WHEREAS, Paulding County, having the appropriate authority for the stated type of project is desirous of providing InSource Technologies, Inc. with the incentives available for the development of the aforementioned Project in said Enterprise Zone under Chapter 5709 of the Ohio Revised Code; now, therefore

BE IT RESOLVED, that the Board of County Commissioners does hereby enter into an Enterprise Zone Agreement with InSource Technologies, Inc. located at 12124 CR 111, Paulding, Ohio 45879 as set forth in said Agreement on file in the County Commissioners’ office.

IN THE MATTER OF APPROVING THE AGREEMENT FOR TECHNICAL ASSISTANCE WITH MAUMEE VALLEY PLANNING ORGANIZATION FOR PROGRAM YEAR 2017 COMMUNITY DEVELOPMENT PROGRAM GRANT

Mr. Mark Holtsberry moved to adapt the following resolution:

WHEREAS, this Agreement was made and entered into by and between Paulding County (hereinafter ‘County’) and Maumee Valley Planning Organization (hereinafter ‘Consultant’) on November 28, 2018; and

WHEREAS, the County desires assistance in the administration of funds available under the Small Cities Community Development Block Grant, specifically the County’s FY 2017 Critical Infrastructure, Grant Number B-X-17-1CF-2; and

WHEREAS, the County desires to engage the Consultant to render certain technical advice, assistance, and services in connection with activities carried out under the approved grant funds; and

WHEREAS, the Consultant proposes to provide the technical services as stated in the Agreement in relation to the Fiscal Year 2017 CDBG fund allocation, commencing upon execution of the grant agreement and will be completed following the preparation of the final performance report; and

WHEREAS, in consideration of the services rendered by the Consultant under the provisions of the Agreement, the County agrees to provide compensation according to the Agreement; now, therefore

BE IT RESOLVED, that the Board of Paulding County Commissioners hereby approved the Agreement for Technical Assistance with Maumee Valley Planning Organization for the Small Cities Community Development Block Grant, specifically the County Program Year 2017 Community Development Program Grant Number B-X-17-1CF-2; and be it 

FURTHER RESOLVED, that it is found and determined that all formal actions of this Board of County Commissioners, County of Paulding, State of Ohio, concerning the adoption of this resolution were adopted in an open meeting of this Board of County Commissioners, and that all deliberations of this Board of County Commissioners and of any of its committees that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.

IN THE MATTER OF ENTERING INTO A CONTRACT WITH WELLNET TO PROVIDE A HEALTH INSURANCE PLAN FOR COUNTY EMPLOYEES

WHEREAS, the Board of Paulding County Commissioners review the County employees’ health insurance plan at renewal; and

WHEREAS, the current policy with WellNet expires December 31, 2018; and

WHEREAS, Brown and Brown Insurance (broker) has submitted a quote for a plan with WellNet; now, therefore

BE IT RESOLVED, that the Board of County Commissioners does hereby enter into a contract with WellNet through Brown and Brown Insurance; and be it 

FURTHER RESOLVED, the WellNet health insurance plan for County employees will be for one year, effective January 1, 2019, through December 31, 2019.

Meeting Notes of Appointments

• Joe Burkard, County Prosecutor & Claudia Fickel, Auditor – Ms. Fickel explained to the Commissioners and the Prosecutor that the Sheriff’s office offers longevity, insurance stipend, and sick leave payouts for employees.  She noted that all are paid on monthly payroll, which causes additional work within the Auditor’s office and is not in compliance with the county manual.  Commissioner Klopfenstein noted that the Sheriff office has a collective bargaining unit and is currently under contract.  The Sheriff also has his own policies and procedures that he and his office follows that allow for the benefits for his employees.

• Vicki Steele, Jerry Zielke, Director, Economic Development – Mr. Zielke presented the Insource Enterprise zone agreement to the Commissioners for signature.  (see Resolution above) Mr. Zielke also noted that he will be speaking at the EDP Wind Hearing at the Extension building on December 4th @ 6pm.
